1.Acceptance of Terms

By accessing and using CueCaption ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these terms, please do not use the Service.

2.Use of Service

CueCaption provides AI-powered image caption generation and prompt building tools. The Service is provided "as-is" for personal and commercial use, subject to rate limits and usage quotas.

The Service is available in two modes:

  • Anonymous Access: Daily rate limits based on IP address
  • Authenticated Access: Optional account creation for credit-based usage with enhanced features

You may use the Service to:

  • Generate captions for publicly accessible images
  • Search for reference images via third-party APIs
  • Build and refine prompts using autocomplete suggestions
  • Export and use generated content in your own projects

3.User Accounts

Account Creation

  • Account creation is optional but required for credit-based access
  • Available via email/password or third-party authentication (Google, GitHub, etc.)
  • You must provide accurate information
  • You are responsible for maintaining account security
  • You must be 18 years or older to create an account

Account Responsibilities

  • Keep your login credentials confidential
  • Notify us immediately of any unauthorized access
  • Comply with all rate limits and usage quotas
  • Do not share your account or allow others to access it

Account Termination

  • We may suspend or terminate accounts that violate these Terms
  • You may delete your account at any time through the account dashboard
  • Account termination does not entitle you to refunds of purchased credits

4.Credit System and Payment

Credit System

  • Authenticated users access the Service using a credit-based system
  • Pricing: 1 credit per search, 2 credits per caption generation
  • New users receive complimentary starter credits
  • Credits are non-refundable, non-transferable, and have no cash value
  • Credits do not expire

Purchasing Credits

  • Credits may be purchased through our secure payment processor
  • All prices are displayed clearly before purchase
  • All credit purchases are final and non-refundable
  • We reserve the right to adjust pricing for future credit purchases

Payment Terms

  • All payments are processed securely via third-party payment processor
  • We do not store your credit card information
  • You are subject to the payment processor's terms and conditions
  • Failed payments may result in service suspension until resolved

5.User Responsibilities

You are responsible for:

  • Ensuring you have the right to use any images you submit to the Service
  • Complying with all applicable laws and regulations when using the Service
  • Not attempting to circumvent rate limits or abuse the Service
  • Not using the Service for illegal, harmful, or unethical purposes
  • Verifying the accuracy of AI-generated content before use

6.API Usage & Rate Limits

The Service enforces different rate limits based on access mode:

Anonymous Users (IP-based)

  • 5 combined searches and caption generations per day
  • Unlimited autocomplete/autosuggestion requests
  • Limits reset daily at midnight UTC
  • Account creation required for continued access beyond daily limits

Authenticated Users (Account-based)

  • Credit-based access with no daily limits
  • Usage limited only by available credit balance
  • Abuse prevention rate limits may be enabled or disabled at our discretion
  • Abuse prevention thresholds may be adjusted without notice to maintain service quality

General Terms

  • Rate limits and credit costs are subject to change without notice
  • We reserve the right to modify quotas to ensure service stability
  • Exceeding rate limits may result in temporary service restrictions

7.User Conduct

When using CueCaption, you agree not to:

  • Circumvent or attempt to bypass rate limits or authentication measures
  • Use automated tools, bots, or scripts without prior authorization
  • Share your account credentials or resell credits to others
  • Attempt to reverse engineer, decompile, or extract source code from the Service
  • Violate any third-party rights or terms of service
  • Use the Service in any way that could damage, disable, or impair our systems

Age Restriction: This Service is intended for users 18 years of age or older. By using the Service, you confirm that you are at least 18 years old.

Violation of these terms may result in immediate account suspension or termination.

8.Data and Privacy

Your use of CueCaption is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

User-Submitted Content: CueCaption does not claim ownership of images you submit. You are solely responsible for ensuring you have the rights to any images you process.

AI-Generated Content: AI-generated captions and prompts created using the Service are provided without warranty. You are free to use, modify, and distribute the generated content, but CueCaption makes no claims of ownership over your generated content.

10.Third-Party Services

The Service integrates with third-party APIs and services, including but not limited to:

  • Third-party search engine for image search functionality
  • Third-party AI service for caption generation
  • Third-party authentication providers for account access
  • Third-party payment processor for credit purchases
  • Other supporting services for infrastructure and features

Your use of these services is subject to their respective terms and conditions. CueCaption is not responsible for the availability, accuracy, or reliability of third-party services.

THE SERVICE IS PROVIDED "AS-IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. CUECAPTION DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

CueCaption does not guarantee the accuracy, completeness, or usefulness of any AI-generated content. Users are solely responsible for verifying and validating all generated content before use.

12.Limitation of Liability

IN NO EVENT SHALL CUECAPTION BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF THE SERVICE.
